Terms and conditions:

These terms and conditions present the legally binding terms. The terms (we, us, our) refer to AVTickets, and (you, your, traveler) relate to the users or customers. AVTickets provides travel- related services, including flight booking services and other travel arrangements to you. By continuing to use our services, you acknowledge and agree to our terms and conditions.

A. General Notice
  • These terms, including the brochures, documents, correspondence, and supplier terms, are the basis of the contract.
  • Under the California Law, these terms contain waivers, limits on remedies, arbitration clauses, class-action waiver, venue selection requirements, and other provisions.
  • When your booking is confirmed with us, it will be considered your agreement to our terms and conditions, and that you have read and understood them.
B. Eligibility

When you are using our services, it will be considered that:

  • You are at least 18 years old and are legally capable of entering into contracts in the state of California.
  • When booking, you have been authorized by the travelers to book on their behalf.
  • You and your group have provided the correct and accurate information.
1. Booking

1.1 You must pay the full amount at the time of booking.

1.2 Before confirming the booking, you should thoroughly check the documents, invoices, and certificates. Inform us in case of any error immediately.

1.3  Your booking is not confirmed until:

  • You provide all the traveler information.
  • You accept these terms (written or electronic)

1.4 On confirming, we will provide you with the payment instructions and the due dates.

1.5 Bookings are subject to the availability, suppliers' terms, rules, and policies (car rentals, cruises, tours, airlines, hotels, etc.)

1.6 We are the intermediary and do not take any responsibility for omissions, supplier acts, or financial standing.

2. Payment and Price

2.1 When booking, you must pay the full payment, and the balance amount should be paid by the given due date.

2.2 If you failed to pay, then:

  • Your ticket will be automatically cancelled,
  • The deposited amount will be forfeited,
  • You will have to pay the cancellation fees,
  • Our package cancellation policy will be applied.

2.3 If you missed or refused the payment, then it will be considered a cancellation by you.

2.4 The discounted or promotional fares are restricted and also non-refundable. To change, you will have to pay the additional cost.

2.5 Planning a trip professionally requires significant time and expertise.

2.6 The paid consultation, planning, or travel management fees are non-refundable.

2.7 Due to the exchange rates, fuel surcharges, supplier pricing, or market factors, the price and the availability might change.

2.8 The professional planning fees are non-refundable.

3. Accuracy of Information

3.1 We try to provide accuracy in the content posted on the website, brochures, and advertising, but some errors might happen.

3.2 Before the booking confirmation, we may correct the pricing or any other details

3.3 At the time of booking, you must verify the accuracy of the travel details.

3.4 Before submitting, you should review all the travel documents, invoices, and confirmations. The names on the government-verified documents should match the provided details.

3.5 The name of the travelers must match the passports and the government ID provided for verification.

3.6 It is optional to write the middle name, but if written, it should be correct, and any error will result in denied boarding and will be charged a fee to correct. You may also need to take a new ticket.

3.7 You are liable to provide accurate personal information for the booking.

3.8 If you have delayed in providing the information or shared inaccurate information, then you will be charged a penalty.

4. Special Requests

4.1 If there are any special requests related to the dietary needs or room preference, then you should confirm at the time of booking.

4.2 Your special requests are forwarded to the travel service provider, but that does not guarantee the fulfillment of the request. In such a case, we will accept no liability.

5. Travel Insurance

5.1 It is suggested that all travelers should get their travel insurance to deal with any emergencies.

5.2 Your travel insurance policy should cover the cancellation, medical expenses, baggage loss, and related risks, following the California Insurance Code.

5.3 If you do not have appropriate travel insurance, then we will not take any responsibility in case of an emergency.

6. Supplier Conditions

6.1 The services are provided by independent suppliers whose terms form part of your contract.

6.2 The supplier may limit or exclude the liability.

6.3 The conditions of carriage of the airline apply.

6.4 The baggage allowances or the excess charges are determined by the airline.

7. Cancellation of your Trip

7.1 The suppliers have their own cancellation policy that they disclose at the time of booking.

7.2 In case of cancellation, the requests must be submitted in writing via email with read receipt, refund, or credits in accordance with the supplier's policies.

7.3 The partially used flight tickets or the tickets with 100% cancellation penalties are non- refundable.

7.4 In case of any emergency or any unforeseen event, the refunds or credits are at the supplier's discretion.

8. Cancellation by a Supplier

8.1 In case of any modification or cancellation by the supplier, we are not liable for the loss and damages. We will notify you as soon as possible.

9. Accommodation Ratings and Standards

9.1 The standards differ by country and region, and we do not guarantee any accuracy or suitability.

9.2 The suppliers provide the ratings.

10. Force Majeure

In the event of a failure caused by events beyond our control or the supplier's control, such as war, terrorism, labor disputes, severe weather conditions, or natural disasters, we shall not be held liable. We will inform you in such a case, or you can contact the supplier.

11. Credit Card Payments, Authorization, and Chargebacks

11.1 All the major credit cards are accepted. You will have to complete the signed or electronic authorization.

11.2 When you authorize the payment, you:

  • Permit us to charge the amount to the card for the travel arrangements.
  • Agree to our cancellation policies.
  • Agree not to indulge in improper chargebacks.

11.3 You can contact us for any charge-related dispute, as we may help you recover the cost of the improper chargebacks.

11.4 You cannot dispute any charges in cases of:

  • non-cancellation reservations
  • charges authorized by the card user (excluding fraudulent activities)
  • Cancellation by the Supplier due to force majeure
  • Dissatisfaction with supplier products
  • Any disagreement with the disclosed cancellation policies.

According to California Compliance, you have the right to dispute fraudulent or unauthorized charges.

12. Fitness to Travel and Medical Conditions

12.1 If any traveler has a medical condition or disability that will hamper their traveling, then you must inform us.

12.2 You must provide us with a medical certificate.

12.3 Your booking may get cancelled by the Supplier or us due to medical conditions.

12.4 You may need to carry medical insurance to travel to some countries. If denied boarding, we will not be held liable.

12.5 When travel insurance is declined, it may cause unrecoverable loss in case of damage.

12.6 When traveling without coverage, we are responsible for paying any loss that the insurance would have covered.

13. Passport, Visa, and Health Requirements

13.1 You must agree and follow all the passport, visa, health, and immigration rules and policies.

13.2 Some countries mandate at least six months' validity beyond the return date for passports.

13.3 Your travel might be cancelled or refused by the airline or authorities when you fail to meet the documentation requirements.

13.4 You have agreed to reimburse us for the fine or fee for the non-compliance.

14. Non-Responsibility Clause

14.1 The third-party suppliers provided by AVTickets are not managed, owned, or operated by us.

14.2 When using tickets, receipts, vouchers, and coupons provided by the suppliers, you agree to their terms. These are subject to the Supplier's policies.

14.3 We are not liable for the lost, stolen, or damaged property; California Law Exception: Gross negligence/ willful misconduct.

15. Travel Advisories

15.1 Before you start traveling, you must review the government travel advisories.

15.2 Such "Avoid Travel" advisories may represent extraordinary scenarios.

16. Reconfirm your Flight

16.1 You must reconfirm the flight schedule with us or the airline that you have booked with within 24 hours of flight departure.

17. Liability, Indemnity and Limitations

17.1 We only own the liability for the amounts for the services that you have booked from us.

17.2 We are not liable for:

  • illness or pandemics
  • supplier negligence
  • force majeure
  • terrorism or crime
  • equipment failures
  • government advisories
  • border closures
  • accidents, injuries, losses, or damages

except when our negligence or ignorance under the California Law stems from it.

17.3 You agree and must indemnify us for any loss, damage, fine, or expenses of any kind that are caused by your actions. This also includes the improper chargebacks.

17.4 Except for our misconduct, negligence, or infringement, you agree and must indemnify us and hold us harmless in case of the violation of this contract.

18. Violations By You

18.1 When violated, it may result in the:

  • Refusal to access our services
  • Forfeiture of the monies paid
  • Cancellation of the reservation
19. Communicable Disease and Travel Disruption

19.1 When traveling, you may be exposed to communicable diseases.

19.2 We are not liable for the losses that may be incurred from:

  • Quarantine Rules
  • Mandatory Vaccination
  • Changes to the Supplier,
  • Government suspensions
  • Entry restrictions due to health

19.3 The refunds or credits will depend on the Supplier's policies.

19.4 We do not take responsibility for any supplementary charges or expenses, such as the hotel quarantine, medical treatment, extended stays, or missed connections.

20. Data Protection, Privacy & CCPA/CPRA Compliance

20.1 We follow the CCPA, CPRA, and federal law.

20.2 Your personal data is collected only for booking and service purposes.

20.3 The collected data may be shared with third parties or suppliers only when necessary.

20.4 Transfers outside the US include protections.

20.5 The California residents can:

  • Delete their data (with some exceptions)
  • Limit the use of their sensitive information.
  • Apply for the correction of the inaccurate data
  • Opt out of sale/sharing
  • Access their data

20.6 We maintain the necessary technical, organisational, and administrative protection for your data.

21. Cookies and Digital Tracking

21.1 Our website uses cookies and other tracking technologies.

21.2 The California Citizens have the option to opt out of some specific tracking or advertising

21.3 By managing the browser history, you may be able to turn off cookies.

22. Dispute Resolution

22.1 To resolve the issues or disputes with us, you can submit an email to us first.

22.2 As permitted by the California/Federal Law, you can waive participation in class/representative actions.

23.4 Compliance with California consumer-protection laws (CLRA, UCL)

23.5 In case of any issues that may arise during traveling, you must notify the Supplier immediately.

23.6 If the issue remains, then you can reach out to us.

23.7 You may submit a formal complaint in writing via email within 15 days of completing the trip.

24. Amendments to these Terms

24.1 We reserve the right to update these terms at any time.

24.2 During booking, whichever version was in effect will apply to you.
